* Education Code 38134 requires districts to charge an amount at least equal to their direct costs when facilities are used for religious services, even when the requesting organization is nonprofit. Activities conducted by religious organizations that do not constitute religious services may be classified according to the applicable user category based on the nature of the activity. Recurring use for religious services may be approved for temporary or renewable periods, subject to periodic review, consistent with Education Code 38131.
Classification Documentation and District Determination. Category II users must submit a current IRS 501(c)(3) determination letter with their application. The District reserves the sole right to determine the applicable user classification for each use and to reclassify a user if the nature, purpose, or financial structure of the use changes. Misrepresentation of organizational status or use purpose is grounds for denial or revocation of facility use.

Minimum reservation block: 2 hours
Holdover and Excess Use. Reserved time must include all setup and takedown time required by the user. Occupancy beyond the approved end time will be billed in one-hour increments at the applicable hourly rate, along with any associated staffing costs. Repeated holdover may result in denial of future use.

Cleaning Surcharge Waiver for Self-Cleaning. The cleaning surcharge may be waived by the Superintendent or designee when the user agrees in writing, as a condition of the facility use agreement, to perform its own cleaning and to return the facility to its original condition immediately following use, including removal of all trash, decorations, and materials, and restoration of furniture and equipment to their original locations. If the facility is not returned to its original condition, the user will be invoiced for cleaning at the applicable rate. This waiver is authorized in this adopted fee schedule in accordance with 5 CCR 14041 and applies to the cleaning surcharge only; facility rental rates and staffing fees may not be discounted or waived except as otherwise provided in this schedule or required by law.
Security Deposit
Category II and Category III users shall submit a refundable security deposit with their approved application: $150 for the CRC Single Room and $250 for the CRC Double Room. The deposit will be refunded following a post-event inspection confirming the facility has been returned to its original condition and all fees have been paid. The District may apply the deposit toward cleaning, repair, damage, holdover charges, or unpaid fees, and will invoice the user for any costs exceeding the deposit.
Cancellation and Refunds
User cancellations received in writing at least ten (10) business days before the scheduled use will receive a full refund of fees and deposit. Cancellations received with less notice will forfeit an amount equal to the two-hour minimum reservation block; the balance of fees and the deposit will be refunded. The District reserves the right to cancel, reschedule, or relocate any approved use at any time for District or school-related needs, facility conditions, or emergencies. In such cases, a full refund of fees and deposit is the user's sole remedy.
Payment Terms, Returned Payments, and Delinquency
All fees and deposits are due no later than ten (10) business days prior to the scheduled use. A $30 fee will be charged for any returned or dishonored payment. Facility use will not be permitted, and future applications will not be approved, for any individual or organization with an outstanding balance owed to the District.
Annual Rate Review
Rates in this schedule are reviewed annually and are subject to adjustment by the Board of Education. The rates in effect on the date of use apply to each use, including recurring or renewable uses approved under a prior rate schedule.
Utilities Adjustment (If Applicable)
Extended evening use beyond normal operating hours or specialized equipment usage may result in additional utility cost recovery charges as determined by the District.
Insurance Requirements
All non-District users must provide a Certificate of General Liability Insurance with minimum coverage of $1,000,000 per occurrence and $2,000,000 aggregate, naming Valle Lindo School District as Additional Insured. The policy or endorsement shall provide for at least thirty (30) days' written notice to the District of cancellation or material change in coverage, and coverage must remain active through all approved dates of use. Applications without proof of insurance will be considered incomplete.
Capital Direct Cost Funds
Any funds collected as capital direct costs under this schedule shall be deposited into a special fund and used only for capital maintenance, repair, restoration, and refurbishment of school facilities and grounds, in accordance with 5 CCR 14042.
Storage (CRC Cabinets)
Storage space requires an approved facility use application, is assigned annually based on availability, and may be reassigned if needed for District programs or operations.
